Question latch booster question

How does this work? Dh's car only allows latching to 40lbs. He thinks since a latched booster isn't relying on the latch to keep dd safe, it's just keeping the booster attached to the seat, that it's ok to latch the booster in despite dd being 43lbs.

Is this correct?

Right. The purpose of LATCHing a booster is so that it's not a projectile when it is unoccupied, and you don't have to remember to buckle the empty booster. When the seat is empty, the LATCH anchors are plenty strong enough to hold the seat (child weight 0 lbs). When the seat is occupied, the seat belt is doing the restraining, of both child and booster. In this case, the LATCH system is really just along for the ride. If the LATCH did fail, there would be no consequences. But really, it isn't going to fail, because the weight of the child is not on those anchors.

That's exactly correct. The seatbelt will hold her. LATCH will keep the booster from being a projectile.
