Can my 4.5 year old fly w/just the lap belt?

I had been considering the CARES harness, but she is awfully close to the limits (39lbs, 39-40").

She will be traveling on a 1 hr flight w/my brother. Has a carseat at the destination. Can she just sit w/the lapbelt?

My daughter started using the lapbelt at 4 for trips when we had a seat at the destination, but she was smaller than your dd. So IMHO I think it would be OK if you can trust her to follow directions and stay in her seat and not unbuckle it.
