Question Booster seat replacement

I was involved in an accident where I was rear ended. Two people including myself and one of my daughters received neck/back injuries. My other daughter was in a Britax booster seat, the kind that goes up the back and surrounds the neck and head for extra protection. She was not injured but I'm not sure about this car seats continued viability. As she is only 7 she is required in our state, CA, to be in a booster seat. We paid for the mode expensive booster for her safety but the insured's insurance company claims it does not have to replace the booster seat because it is not technically a car seat as it is strapped into the cars seatbelt and does not have its own seatbelts. Is this true? I have not been able to ascertain whether this is true or not.

The Parkway's manual will state that it needs to be replaced. It follows the NHTSA criteria for a minor collision. Because there were injuries it's not a minor collision, so it requires replacing.

:yeahthatmad: Sorry to hear the insurance company is giving you a hard time. Another thing to add to your leverage in dealing with the insurance claim is that in California, insurance companies are required to cover replacement of carseats that were occupied during a car crash. The insurance company evidently needs to be reminded of that California requirement as well.

It might help you, when speaking with the insurance company, to use the term "child restraint" instead of car seat and booster.

They are trying to claim that a booster isn't an installed car seat, which is nonsense. It was an occupied child restraint, and they need to pay to replace it.
