You are correct. In the States, FMVSS213 does not provide any standards for after market items to be crash tested.

Car seat manufacturers usually have statements in their manuals regarding this type of item.

Concerns would be: Does this meet flammability standards? Will it compress in a crash (making the harness too loose) which would not ensure a child be properly restrained?

They use what appear to be ice packs and those could over cool a child during a drive, and that is another list of issues.

the koolseat is used while your child isn't in the seat, to keep it cool. Same idea as throwing a towel over it, etc to keep the sun off it. I wouldn't have a problem with it being used, assuming it didn't sweat and leave the seat soaked in water. If you watch the video on the page, it gives a break down of how it's supposed to be used.
