I have an almost 6 year old under 40 lbs and 39" tall. The back seat of my husbands 2 door eclipse has a low back. He is too tall for his car seat now. The seat belt actually fits him without a booster since the back seat is so small and the belt comes out so low. Can he go without or is there one that will fit?

In what way is your son too tall for his seat? Which seat is it? A kid that size should have plenty of growing room in most FF harnessed seats. Most kids his age need at least a highback booster to remember to sit properly. We could recommend some that do not require a headrest to support the booster.
Sometimes the seatbelt looks like it fits without a booster when it doesn't. Please read this link about how to be sure he is fitting properly without a booster and mature enough to do so: https://carseatblog.com/3966/the-5-step-test/
If he truly passes the 5 step test and the seatback comes at least to the top of his ears, he could ride without a booster.
