Would you use this seat?

My sister's car was hit outside of our house sometime last night- this morning. From looking at it, it was swiped by a car passing by. It is still drivable, but because of the age of the car and other issues with it, will probably total the car. We had a baby trend flex loc base installed center, and a graco headwise installed on the drivers side. The car was hit driver's side. We have another flex loc base, so that's okay, and the seat wasn't in the base. The child in the headwise should still fit rf in the my ride that we have, so I could out that in for her. So, use the headwise or not?

State Farm is arguing with us over replacing the seats. They are saying they will assess the seats and decide if they need to be replaced. I know that doesn't fly. What can I say in response?
We apparently don't have comprehensive on the car so they won't replace. Nevermind.

That sinks. :( Call Graco and Evenflo and see what they say, but they might both be "replace after any accident". I can't recall. At any rate, I'm sorry someone side swiped the car. :(

Both companies state to replace after any collision. IMO if you are contacting insurance, seats must be replaced.

OP, if they refuse to replace the seats, ask them for a letter on company letterhead stating that they take responsibility for the seats being used against manufacturer guidelines. You won't get that letter, you'll likely get a cheque. This varies by state, but usually works.

We don't have comprehensive on the car. It's a 2000, over 200k miles, so we can't get anything unless someone fesses up. We were actually shopping for it's replacement yesterday. I'll contact graco about whether it needs replacement later. We called insurance because my dad thought we did have collision for some reason. We were only hoping it would be totaled since we were shopping for its replacement. We wouldn't actually repair it if it were not getting replaced anyway.
