"top of child's ears" rule...question

"When front facing, the tips of a child's ears should not be above the top of the carseat to allow for whiplash protection."

So my question is...let's say for a Roundabout, whose max child weight is 40 lbs, if my child is 40 lbs but ears do not reach top of seat, can she still safely use it??

No.

The seat is outgrown if any ONE of the following is true

1. The child is 40 pounds
2. The tops of the ears reach the top of the seat
3. The child's shoulders are taller than the top harness slot.

But is it outgrown at forty lbs or at forty ONE lbs?
It is still usable at FORTY lbs, right, if it says 5-40 lbs?

The seat is usable TO 40lbs (in essence, 39lbs 15 oz). Usable to forty-one pounds would say, "40lbs or less" or "for children weighing between 5 and 41lbs" in the manual.

It is outgrown at 40 lbs, not 41. The actual wording is "Use only for children who weigh between 5 and 40 pounds..." Technically, that would 5.0-40.0 lbs (or maybe more like 5.01-39.99 ;)) - not 40.5 or 40.9...

Now, I really don't think 1/10th of a pound in either direction is going to affect perfomance in a crash. That could be the difference between a heavier sweatshirt one day than the next. However, I don't think it's worth pushing it. :twocents:
