My oldest wasn't 40# until almost 7yo. He went to a HBB in our car after we lost his seat in a crash. In our RV, there are no head rests and we go for long trips, so while he does sleep upright, I still prefer him in a harnessed seat and he will remain there for the next year (or so) when he outgrows the Frontier.
My youngest son is is almost 40# at 4.5yo. He's not neurologically (Sensory Processing Disorder), so I can't imagine he'd sit properly and resist temptation in a booster, so he'll be harnessed for another year or two...
