In most jurisdictions, possibly. In Canada, seats that don't meet the current standard cannot be sold, so not right now since there was a new one a couple years back. In the US, it varies. In my state we have very very strong consumer protection laws which state that an item for sale must be fit for use for one year from date of purchase. As a proper use state, expired seats don't meet that criterion (unless sold as a collector's item.) (We also have a law against selling crashed seats, specifically, by anyone.)

It isn't an issue to use an expired carseat as a doll carseat, or a "restaurant" seat, or for some other non-vehicle application, but those are the only reasons I would advocate even considering using an expired (or used without knowing the history) seat. :)
