42 lbs and the Velcro barely stays connected.

Which version and does the buckle keep the vest closed? Can you put him in really heavy shoes and go with the large? JK, lol!

Personally, I'd call the makers of the vest and see if they would approve use of the large before technically able.

The gray one with 2 buckles? If so, I'd try version 2 if you'll ever only have a lap belt or version 3, if you'll always have a tether. I can't remember the differences between versions 1 and 2, but better fit may have been one of them. Version 2 comes with the tether and version 3 does not.

version 2 is also to small. and version 3 requires lap and shoulder belt so not an option for the seating position we are in.

Then you may have to look into an ez-on vest until he hits 50 lbs, unless the company ok's you using it under 50. I'd give them a call.
