Florida seat laws?

I searched but couldn't find it.

A friend of mine knows someone with a 28 month old in a backless booster and a 10 month old FF. She has told her about how unsafe it is, but the mother of the children dismisses her concerns and hasn't changed. She's going to try the "it's illegal" route next, but is it really? And if so, where can we find that?

316.613 Child restraint requirements.--

(1)(a) Every operator of a motor vehicle as defined herein, while transporting a child in a motor vehicle operated on the roadways, streets, or highways of this state, shall, if the child is 5 years of age or younger, provide for protection of the child by properly using a crash-tested, federally approved child restraint device. For children aged through 3 years, such restraint device must be a separate carrier or a vehicle manufacturer's integrated child seat. For children aged 4 through 5 years, a separate carrier, an integrated child seat, or a seat belt may be used. </quote>

"Properly using" a seat means following the manufacturer's age and weight guidelines.

You can find the state laws on Safe Kids. I like it because it dumbs down the legalese and points out the gaps in coverage.

Only children ages 3 and under in all seating positions must be properly restrained in an appropriate child safety seat.

When Florida does mandate child restraint use, it requires the driver to secure both the child safety seat and the child properly. ~ safekids.org

Gee... FL's law is just about as bad as Texas's law is. I wonder if it was the "brother effect"?
