Children and Motorcycles

Obviously it varies by state, but does anyone know of laws that restrict kids from riding on motorcycles? Someone on another board is wondering, particularly about Alabama. (Don't worry--she doesn't want to get a kid ON one--she wants to get him off. Kid is 3 or 4.)

Is it illegal if kids are under the age/weight/height of the state's child restraint laws? (In other words, if it's a 4/40 state, a 35-lb 3-yr-old can't be on a motorcycle, but a 41-lb, 4-year-old can?)

In Oregon, at least, motorcycles are exempt from restraint laws, even for children. I'll have to look up any other specifics. Some laws have requirements such as "child's feet must be able to touch foot pegs", IIRC.
 
i'm not sure on the legal part of that but really i don't know of any 4 yr old who would be able to hold on to an adult firmly enough to prevent them falling off. i'm not even sure you could find a helmet for a child that small

She said the kid sits between the dad and the handlebars. :rolleyes: Hmmm...maybe that aspect of it is illegal?

Yes, I think that aspect of it would be illegal, at least in most states that I've read about. Even in the states that have no age restriction on motorcycle passengers, it seems that they all specify the passenger MUST be sitting in a seat designed for a passenger, NOT sharing a seat meant for the driver.

And, FWIW, they do make motorcycle helmets for tiny kiddos. My H has one that fits her perfectly.
