I am not into lying but a family friend recently emailed me to ask me about the new MA law and whether she needed to put her very small 9 year old back in a booster. I told her about the 5 step test and that he failed that so yes he should. He is not safe in the vehicle seat belt. She thinks he is fine but wants to know what she is legally required to do. Since he doesn't reach the minimum height required by the law. She is going to go by the law and thats it. Her son still has a good 2 -3 inches till he fits that height. The law states OR not AND but i am really thinking of lying to her and saying its AND. Would you do the same.

No, I would not. It will be fairly easy for her to independently confirm whether or not what you've told her is the truth. Lies always come back and bite you in the butt eventually, and lying about this will make you lose all credibility in the future.

I'd be honest about the law, and honest about the reason why he should still be in a booster. After that it's her decision. Sometimes we have to step back and let other parents make decisions for their own kids and just hope that that decision isn't a fatal one. :(

I agree.

I agree with the others. If you lie, and she finds out, you have lost all credibility with her.

"For some reason, they made it x OR x. Can you believe that? Like a seatbelt knows how old the kid is and adapts to fit, right? Well, I think it's more for people that never reach that height... you know, you wouldn't want to be thirty and still in a booster, right? I guess at that point, you're an adult and can make your own educated choices. It really is weird, though, since it's always stated and confirmed that seatbelts just don't fit people under X inches tall. Of course you'll want to keep J in a booster, since he isn't tall enough yet for a seatbelt and it just doesn't fit him safely. Hey, I saw that store has some on sale this week, , he'd probably love to pick his own."

I would not lie, but tell her that the OR usually means whichever comes last... unless he outgrows the booster.
