insurance coverage questions

Not that I've had a wreck, but just for general knowledge...

Does the at fault party replace the seat regardless or whether it was the other person's fault or your fault? So in other words, if the accident was my fault, would my insurance cover the seat?

I would assume some companies make things easier than others. We may be in the market for new insurance, as our rates just jacked with a ticket hubby got...might see if we can get it any less. Any particular ones that you really give the thumbs up for carseat issues?

I've heard some people :thumbsdown: Geico which is what we currently have, are they particularly difficult when it comes to seat replacement?

From my experience and what I've read here- insurance companies usually replace seats only if the other driver was at fault. If it was your fault, your insurance is under no obligation to replace the seats because they are considered personal property. Some still will, but they don't always have to. In CA there is a law that states all occupied seats must be replaced after a crash (although we know unoccupied ones need replaced as well).

And in California, the insurance of the at-fault party pays to replace the seat.

I had Geico for my first accident and they gave me no trouble whatsoever to replace the seat. But then again, I am in California, so they have to follow the law.

In the second incident, someone back into us. Their insurance cut us a check for the replacement value.

Geico was really weird in replacing our seat. They at first said they would recycle it (huh) and then made us give them the cover, which makes me think they are up to something. Also, the limited the replacement to $200.

As it was explained to me by a CSR at Progressive Insurance, if it is the other person's fault, his or her insurance should cover it. If it is your fault, carseats come under comprehensive coverage, which not everyone carries, and which is subject to a deductible.

Well that could potentially suck. If I rear ended someone in a situation where I had no chance at stopping, yet would technically and automatically be at fault, and I had five kids in seats...I couldn't imagine having to replace all of those myself on a moments notice! They cover your car (assuming you have collision). The carseats ought to be considered part of the car since they are so expensive and in some cases could cost more to replace for several children than the car damage! Hmmm, okay thanks for the answers!
