is that really how you would use it? the belt is so high on his tummy.

I doubt it matters, now that I think about it.... the forces will be spread evenly over the shoulders and the lapbelt shouldn't gut the kid at all (in airplane turbulence or crashes, I don't think lapbelts gut anyone, anyway, this would just reduce the risk ever further).

I don't know if that's proper use, but that kid looks like he'll get severe abdominal injuries on landing and braking.

That looks like user error to me. It seems if you snugged the lap belt down very tight across the hips and then tightened the shoulder harness, that wouldn't happen.

I'd say it's misuse, too. From their installation instructions:
Buckle the seat belt and pull it snugly across your child’s lap as you normally would do – and then buckle the chest clip and snug down the Shoulder Straps.

They seem to have tightened the shoulder straps first and then buckled the seat belt.

Check out the review from the authors of the Passporter, they had some issues of submarining and it was somewhat addressed by the inventor at the bottom of the page.

The kid in the first picture his seat is reclined...and I don't think you are supposed to recline the seat when it's in use, but I'm not totally sure.

The second picture the red belt should have been positioned lower, and the shoulder straps shouldn't have been shortened quite so much.

When Reigan is in hers the lapbelt doesn't come up that high at all. But I also wouldn't recommend using it for a kid as small as in the first picture either...I'm not sure if you could adjust it to properly fit the child.
