Broken EPS foam in Side Wings?

I was at a friend's house yesterday and we were talking car seats. She pointed out that the EPS foam on her car seat on both head wings was broken, to the point where in an accident, her DD's head would hit all shell and no foam. I think her seat is an Evenflo and is about 2-3 years old. Is this a safety issue? Should she call the car seat manufacturer to have the foam replaced, or replace the whole seat? If it's not safe for her DD to ride like that, does anyone have an links or articles that I can give her?

Considering many seats don't have ANY EPS foam, I would think it would fine...however, I would call to ask for replacement. But would probably use it till it came.
