Harmony defender tether question

How does the harmony defender get away with requiring the use of the tether at all times in the US? I thought all seats had to pass testing without the tether and seats could only require them past a certain weight- like the frontier is past 65 lbs.

I believe that a seat has to pass crash testing without the tether attached, but they can still put in the manual that the top tether must be used.

Others have contacted Harmony and been told that the seat can be used without a tether if absolutely necessary (no tether or retrofit available) and that the intention of the instructions is to not give parents the feeling it was "optional."

So it does pass without a tether then? Not that I would use a seat without one but it interests me to see how testing regulations and manufacturer instructions differ sometimes.

According to FMVSS, it has to pass testing without a tether (although the testing requirement is more lenient).

Yes, they also have to pass the misuse standard without a tether using lower anchors, but almost no seats allow that.

The Clek Foonf doesn't allow use with lap only belt without a tether. Neither does the Porsche Junior Seat LATCH.
