car seat / accident question

Has anyone had the 'pleasure' of working with Selective Insurance. It's a corporate insurance policy (?). Someone, in a company vehicle, rear-ended my husband. My husband had a Britax and a Radian in his car. The Radian must be replaced, but Selective is fighting this pretty hard. They are arguing that replacement of seats "is a gimmick put in place by car seat manufacturers to make more money". We've sent them the manual and pointed out the part where it says the seat needs to be replaced. We've also provided links to the cost of the seat and sent pictures of our seat...

No experience with the insurance company, but I have heard of others having success but telling them if they refuse to replace the seat when the manufacturer has set that guideline, then you require a letter from them stating they accept full responsibility for using the seat against manufacturers recommendations and take fault for any future injury or damage.

:Yeahthat: DH was rear-ended by a drunk driver and this is the line we had to use with his company, Gieko.

Sorry for the dumb question, but why isn't your insurance company fighting this? I didn't deal with insurance companies at all with any of our accidents (none was our fault), it was just ours. We told ours what we were going to do, and they made the other company do it. Easy for us! :)
