Booster it is then! Thanks everyone. I hope he 5 steps by next Fall. I don't want to make him ride in a booster in middle school.

the shoulderbelt is the part I don't like. the lapbelt is probably fine (his shirt is long, so hard to be sure)... I know Jeffrey can't stand a shoulderbelt against his neck, so it would have him leaning.

I'd keep him in a booster until he outgrows it, or at least until he's 13, cause he is definitely close.

If you really want him unboostered, try a different seating position. My 10yo passes in the center of a Subaru and Kia, which both have humps in the center. I've also seen her pass in the third row of a SUV (don't remember which vehicle, but it was a small third row).

He goes into middle school fall of '13 so not a huge rush. He didn't complain at all about having to use it today. I will just keep it as us for now. I can't do him in the center with 2 RF Radians in there. It's too much of a pain.

He looks like he's trying entirely too hard to stay straight as a stick so the lap belt rides low. LOL So I would expect him to slump a tiny bit while riding around and that would make the belt fit even worse. It looks ok on the side by the door, but by the buckle it's way too high.

ETA: I would think he'll 5 step within a year. I wouldn't worry about it. :)
