Question When seat outgrown FFing?

DS is only 34 pounds. But I noticed on the way home in the secondary car his head is starting to poke over the top of his Marathon--when is that seat outgrown height wise? Is it safe with his head not entirely inside the seat?

When the ears are over the top of the shell, or when the shoulders are over the top slot, whichever comes first.

Oh! Harness is supposed to come down over when FF isn't it? I think he needs his harness changed to top slot. Tomorrow...
