Booster Law question

Okay I always thought it was 8yrs was the legal age for a child to be out of a booster. --I took my DS to the Ped for his 8yr old check up and he asked him about using a booster. DS said he still did and doctor said good because 4'9 80lbs is the law. DS said he thought he should be out since he was 8 (he gives me this every now and then because hes probably the only one in a booster still...) Anyways what is really the law? (I'm in IL I do realize that there are a few states that are behind on the 8yr thing but he just had me kind of confused.)

Also how important is that 80lbs? Just wondering where that number came from.

ETA: DS is going to stay in his booster until he passes the 5 step thingy...

Regardless of the law all children need to remain boostered until they pass the 5 step test or until puberty (about 12).

The 80 pounds and 4'9" numbers are a broad generalization of when children will fit properly in just the adult seat belt. I have yet to find an 8 yr old that meets all the criteria of being in just a seatbelt. My oldest is 9.5/83# and almost 5 feet tall and doesn't 5 step in any vehicles I have tried him in except the third row of my Yukon.

I understand that part (DS's friends probably think I'm the crazy mom because he rides in a booster they would to if I was to drive them anywhere)...I just thought it was odd how the doctor made it sound like it was a law not a recommendation. I guess I was just checking to see if anything had changed law wise.

The law is different state to state. It's 8 in IL and 6 here in CA. Clearly you have a great ped. who realizes that kids should be in boosters until they fit in adult belts; the 80 lbs and 4'9" are general estimates of when that will happen, but I don't think they are the law in any state.
