A co worker commented to me last evening that her daughter heard she should be in a booster until she is 4 - 9, so she put herself back in her booster. Don't know the kiddos age, but I directed her to the 5 step test and showed her the iihs page where correct fit is shown. She was reading it when I left! Yay!! Finally a bit of positive.

 Cool beans!

I've been trying to convince my coworker that it's illegal to have her grandson in a backless booster- he's been that way since his 2nd birthday, he's now 3 1/2 and still not 40 pounds.

Cookie, awesome!!!

It may not be illegal. The Dorel backless boosters start at 1 year and 30 pounds. Unless you're in a 40 pound state, anyway.

I am in a 40 pound state, New York- I've even given her a link to the DMV site showing car seat law and penalties for not using the proper seat.

NY's a proper use state, not a 40 pound state.

Children under age four must ride in a federally approved car seat. Effective November 24, 2009, New York State law requires that children ride in an appropriate car seat or booster seat until they reach their 8th birthday. Children under age 16 are required to wear a seat belt. The state further recommends, but does not require, that children remain in a booster seat until they reach 4'9" or 100 lbs and can sit in the adult seat belt properly.

That's from http://babyproducts.about.com/od/statecarseatlaws/qt/newyorkcps.htm.

The only thing NY has about over 40 pounds is that a child under four who is more than 40 pounds can use a booster legally. But nothing about my 36 pound six year old being illegal in a booster.
