need studies or data regarding booster seats

Are there any studies or anything that prove a child is safest riding in a booster seat until they fit properly in the seatbelt without? I don't want studies showing 4-8 year old kids are safer. I want something based on size rather than age.

Maybe in Germany. You won't find it here I don't think, because of the restraint laws. But, it is because of a study of 4-6 year olds, that NY upped their child restraint law to age 8, from 6.

The only thing I can think of is if you can convince the person that since it helps 4-8 year olds, by properly fitting the belt, wouldn't it make sence that it would all children, by having the belt fit properly.

Maybe this?...
They don't really seem to collect *size* data, though, just age data. http://www.ncbi.nlm.nih.gov/pmc/articles/PMC2529446/

Children between eight and 12 years of age are also at increased risk of seat belt-associated injuries, probably because of inappropriate use of seat belts (use of lap-belt only or three-point seat belts worn behind the back or under the arm). Furthermore, children have characteristics putting them at risk of seat belt-associated injuries. Their intra-abdominal organs are less protected by the thorax and pelvis, their posterior ligaments of the spine are less well developed and more easily torn, and their iliac crests are less developed than those of adults, allowing the belt to ride up over the abdomen (4,6).
The risk of injury to inappropriately restrained children is nearly twice as high, compared with appropriately restrained children (OR 1.8; 95% CI 1.4 to 2.3); whereas unrestrained children are at more than three times the risk of injury (OR 3.2; 95% CI 2.5 to 4.1) (20).

not a study, but I posted a great video that shows some crash tests that illustrate it well -http://www.car-seat.org/showthread.php?t=157285

That's the video that spurred the discussion:) (Not sure that the antagonist actually watched the video, though.)

well, glad it's been spreading quickly. When I saw it, I hoped it would... I think it makes quite a very visual and real idea of what can happen in a seatbelt that doesn't fit or isn't worn properly.
