Crash replacement

I have a friend that was just in a crash. Geico is taking responsibility, but when she asked about replacement, she was told that Oregon law does not require them to replace the seat and the adjuster will determine if it needs replacing. Uh, what? :confused: I don't think there is a law like that here. Also, she has a Myride and I told her Graco requires replacement. Her two year old was in the seat at the time, FF, but everyone is ok. Do states really have rules like this?

As far as I know, only two states have laws that require replacement of the seats. California requires the insurance company to replace seats when they were occupied. I'm not sure if Illinois specifies occupied vs. unoccupied.

Are you saying the guy said that Oregon has no such law? If so, that's probably true. Are you saying he said that Oregon has a law specifically NOT to replace seats? If so, he was likely either misunderstood or misinformed.

I would have your friend fax over copies of the manual where it states the seat needs to be replaced and take it from there. Hopefully the adjuster will be reasonable and will agree to replace it.

The guy was saying that Oregon has a law that says they DON'T have to replace any seat, but that the adjuster would determine if they needed to replace it. My friend found her manual and found where it says to replace. I told her not to let them off the hook and there was no way for an adjuster to determine if her seat was damaged or not.

I suppose it's possible that Oregon's insurance regulations have some kind of wording saying that insurance companies don't HAVE to replace them, but more likely it's not addressed one way or the other.
