3 yr old has been in a booster for almost a yr :(

So I am babysitting for a friend today that I haven't seen in a while and when her husband dropped the very petite 3 yr old boy off he dropped him off with a evenflo booster :( BOO :thumbsdown: I of course have an extra seat that I will put him in. He just turned 3 and is more petite that my tiny thing that still has plenty of RFing room in her MA.

So my friend will be picking him up at a restaurant tonight, whats a good approach to use, I think it is illegal in my state for under 4 to be in a booster (TN??)

I will obviously let her know that I put him in one of Jocelynn's seats because I didn't want to get a ticket and that I felt better strapping him in.

Should I send her a message on facebook too?? Or just make a light mention of it, this little boy can NOT be more than 30lbs clothed, Jocelynn is 28lbs and much bigger

Most states do NOT require children to be four for a booster, and most people who think that they do are misreading the actual text of the law, so I would be very careful about using that approach. If he meets the height and weight minimums, he's legal to ride in the seat. If he doesn't, he isn't.

If you have a link to your state's actual law (not just a summary) I'd be happy to take a look-see :)
 
Does this look like the right link - if the text "child safety seat in the forward facing position" means a harnessed seat, it sounds like the 3YO *is* supposed to be still harnessed:confused:

yeah the wording is very vague but most people here assume 4yrs as the booster min . . . I know that I don't want to A) be responsible for something happening to a child that small in a booster and B) Get a ticket for it because they do seatbelt checks around here all the time and they DO check for car seat use. I have actually seen someone getting a ticket for a 2 1/2 yr old in a booster here.

That being said He cannot be more than 30lbs . . . the booster is an evenflo highback, what is the min weight on those??

So my end is solved but I do love my friend and her little boy and she prob honestly thought it was ok . . . that being said would you make it a big deal or a light mention and how would you go about it, I usually argue the my DD is RFing because . . . lol I have never had to have the booster convo lol

I would approach it from a safety standpoint. Tell her about how a 5 point harness evenly distributes crash forces vs a seatbelt, etc.

Is there a way you can contact her before putting him in a different seat? *We* know it's safer but if someone put my DS in a different seat than the one I provided without attempting to contact me, I would be livid and I would hate for her to get mad at you. Maybe just let her know you aren't comfortable about putting him in a booster because a 5 point harness is safer. Good Luck!! :thumbsup:
