Legal Liability cases?

I'm trying to get someone to not sell used seats. Does anyone know of any cases where someone has been sued for selling a car seat that didn't hold up in a crash? Just want some info to show that it can happen.

I don't think there are any. It would be very difficult to prove that the failure was due to it being a used seat.

The thing with lawsuits is that they can name whoever they want in a suit. It's normal for everyone even remotely involved to be named. A person may be found not liable in the end, but they've still had to pay all the attorneys fees to defend themselves. Maybe point out that they don't want to be involved in that mess.

You also never really know what will happen. Juries have been known to rule with their hearts and not with the law at times. There was a lawsuit a few years ago that is a good example. A man leased a vehicle. He let his 19 year old son drive it one night. The son lived on his own, wasn't a dependent. The son drove drunk and had a tragic accident. He hit a pedestrian. She was very hurt and will require care for the rest of her life. The girl's family sued everyone. They sue son for driving, dad for being the owner of the car and letting son drive, and the LEASING company because they are also an owner of the car. In the end, the son and dad's insurance companies paid out whatever their policy limits were. The jury awarded the biggest liability portion to the leasing company. It was because they felt sorry for the girl and that she needed the $ to have the care they required. The leasing company was the one with the deep pockets that could fill that. I believe this happened in New York. I know there was a time period several manufacturers stopped leasing vehicles in that state because of this.
