Question RSTV - size small - poor fit?

We just got the new RSTV small for DS for cab rides this summer. He falls just within the weight and height limits (30lbs, 39"), but the vest doesn't seem to fit properly.

His torso seems to be too narrow and too short. There's space between his shoulders and the top of the vest. We also have to overlap the right and left sides to the point that the one side of the vest interferes with the buckle.

Has anyone else had the same problem? Or are we using the vest incorrectly? (We place the vest just high enough so that the tab on the bottom bends at the crotch.
