mini-bus belt or no belt? (merged thread)

Kids ride a mini-bus to after school program.
They are told no belt needed.
It's not a school bus...so...I figured a belt would be good. They have belts on it.
Problem is there is a harness (I think the preschool uses these as it's a preschool bus), or they said if they pull out the belt, then it functions as a regular lap/shoulder. But it's hard to do and always way loose and hurts their neck. This sounds horrible.

Should they ride without a belt?
Use this awful sounding belt?

They got rid of the 15 passenger van 2 years ago (where kids rode in nothing except a lap belt) so that's good. But I thought this new bus would be awesome and the kids are saying these things, so, hmmm...a loose belt that hurts their neck? I don't want something ON their neck in the first place.
But no restraint at all makes me nervous due to laws of physics.

Driver said they don't have to wear the belt.

Do they wear the belt given it sounds awful?

It is not a school bus exactly. It's brand new with high seats (they used 15 passenger vans before and kids in past programs were in lap belts.).

I figured they should wear any belt there in this mini-bus due to laws of physics. But...there is a harness (it's used for the preschool) that the school-aged kids don't use. Somehow you pull it out to use a lap/shoulder belt too. They said it's difficult to do this, and the belt is loose and also hurts their necks. So I am imagining a loose belt, and ON their necks. Sounds not so great. Like an injury waiting to happen in a crash.

And my 6 YO was being made fun of b/c he put his belt on. I taught my kids to always buckle up. And now, with the info above about these belts...torn what to do.

Can you ask to see how the kids fit in the seats? Let them know you are concerned...
