Is booster w/ 5pt harness safer for child over 40lbs?

Hi,
My husband and I are debating whether or not to get a Britax Marathon for our 37lb 3 yr. old. We're wondering if the 5pt. harness makes it safer than boosters with shoulder belts for kids over 40lbs. This is a point of contention, because my husband is worried that in a year or so, my son would start noticing that everyone but him has a shoulder belt, and will start refusing to wear a harness. (BTW, we need to move him very soon because our little one needs to move into his convertilbe)
If the 5pt. harness is not significanlty safer, what booster seat would you recommend for our 02 Odyssey?

There is not a clear answer. A properly fitted lap+shoulder belt with a booster protects very well in a frontal crash. Some crash test measures are even better than those of harnessed seats. On the other hand, they provide less protection in side impact and rollovers than a 5-point restraint.

By far the biggest issue is whether or not the child can stay seated properly in a booster for a while trip. If they squirm around a lot, put their heads on the door or window, put the shoulder belt behind them or otherwise compromise the safety of the seatbelt then they would probably be better in a 5-point harness. If they can stay seated properly and the seatbelt is fitted correctly, then they will also be well protected in a booster.
