So mad at Colorado legislation!!!

This is a law that is about to pass here in Colorado <img src=http://www.ezboard.com/images/emoticons/eek.gif ALT=":eek"> !! I can't believe that after all that I read about rear facing they would put a law like this out there!

"Child one year of age or older but less than 4 years of age and weighs less than 40 pounds but at least 20 pounds, child shall be properly restrained in a forward facing child restraint system."

That is pretty poorly worded-

I personally would take my chances and appear in court armed with all available data if I was ever issued a citation for rear-facing beyond 20 pounds.

Clearly the intention was probably to keep kids under 40 pounds out of a booster, but they bungled the language:-(

Sadly, the police officers will bear the brunt of the public ire for any citations, when it was clearly the legislature's fault.

If you have one, would you please post a link to the legislation with the quote you posted? Thanks!

IIRC, one of the first states to pass a mandatory booster...

If I recally correctly, one of the first states to pass a mandatory booster law made a similar mistake, and it only took their legislature a couple of months to fix the wording.

Re: So mad at Colorado legislation!!!

My sister (a police officer) wrote this in response to your post Darren,
It is House Bill 1070. You could also contact the DA's office and ask them for help (it is not law yet and I bet some tweaking could still be done). They might be able to put you in touch with whatever congressperson or senator who sponsered the bill. Articles from the Rocky Mountain news might say also.

If you do not want to deal with all of this - Molly the social activist- I can call the DA and bring the conserns to his attention. (He told us to call if/when we see law issues that conflict). The only thing is that I am busy until like the middle of February. You might want to just remind me in February and I can get on it. For all we know, someone has already made the change and this is all for nothing. Let me know - I can make it a SARA project, get credit for it, but again I cannot do much until February.

If Darren could send me some facts and their recommendations, I go to the DA with my facts in order.

Sarah
I will try to get her some more information and try to get the wording changed!
Thanks!

Thanks- Here it is:

www.state.co.us/gov_dir/l...sl.301.htm

Apparently, similar bills have passed in other states, and some have been quickly corrected after pressure from child passenger safety advocates.

I am trying to get some information on this from Cheryl at SafetyBeltSafe USA. If you would like to send me an email to the address in my profile, I would be happy to send you anything I receive from her. In addition, we have a page of rear-facing information with links to other sources as well:
