Hiya! The harness needs to come from below his shoulders, not above. So you might not be as close as you think you are. Also a child is to big for the infant seat (or any convertible seat) when they have hit the weight limit or when they have less than 1 inch of hard shell above their head. You should have a little while longer in this seat.

I hope this helped you.

If his shoulders are above the top slots, but there is still more than 1" of shell above his head, he still fits.

Are you sure that he almost needs the top slots?

Please remember that the harness must be AT or BELOW the baby's shoulders when rear-facing.

To need the top harness slots would mean that his shoulders are at or above the top slots. Is that the case?

I would probably get a new car seat soon because newborns grow fast. The other reason that I would get a new car seat is because I do not trust the Evenflo infant car seats(they have had many recalls). I do not know if you are interested in buying a new car seat but Graco car seats are in the same price range and seem to have a good reputation.

This is just your opinion though. All carseats sold in the US have to pass the same tests. We don't know what the results are or what ones pass with flying colours and which ones barely pass but we do know that they all have to pass and are considered safe to use if they are inistalled correctly, fit the child and are used properly every time.

To the original poster, like said before for rearfacing you want the harness to come from below the baby's shoulder. Here is some information on how to tell when your rearfacing seat is outgrown. (http://www.car-seat.org/showthread.php?p=278124#post278124)

Yes, babies do outgrow seats quickly, but there is no reason to rush to buy a new one unless the current seat truly isn't working for the family due to it being outgrown, expired, or incompatible with the vehicle.

I am not a fan of Evenflo's infant seats either, but that is just my personal opinion. If the OP's seat is being used properly, fits her baby well, and fits the vehicle well, she can continue to use it.

OP- if you are truly concerned that your baby has outgrown his seat (which most likely hasn't happened yet) and you are ready to move him to a convertible, let us know. We will help you with selection of a convertible. :)

he has a 9 1/2 inch torso is about 1/2 inch from top slot before it's under his shoulders
if we put him right in the middle of the seat it almost looks like the top slot is under his shoulders and he has about 4 inches from top of head to the top of the shell

We usually sugest to sit baby against the wall and mark where their shoulders are and then measure from the floor to the mark to get their torso height. This could be hard to do with a 2 week old. Is he a big baby?

The slots on the embrace measure about 5", 7" and 9.5". So you just want to make sure that he is even with or above the slot. Remember at this age baby will likely slump down into the seat so check when putting in and again after your trip just to see how the fit is at the end.

he really isn't a big baby weighs about 8lbs and about 21 inches long
we did have him sit by the wall and thats how we got the torso height
when he slumps down thats where when we get the 1/2 in where the harness is above him the bottom slots hit his lower back the middle slots hit his middle back
we just have long torso from his dads side we need a plan for the next seat
currently in my car my son is in a rf radian he is 4 9/23 my daughter rf radian
holland rf evenflo embrace

Then I would put the straps where they are below the shoulders.

I tried my newborn out in the truefit and she fit quite well in it. The Radian is also good for small babies.
