Ok, i am a bit in the dark here about what potential liability issues I am getting myself into by 'misusing' my 48lb radian...I thought that the proper use clauses only really applied in the US, and were more about lawsuits, which don't seem to be such the thing as they are in the US. Would I actually be in a position to sue the company (SK) in the event of an accident? Can anyone clarify exactly what liability issues might potentially affect me should I use my 48lb stickered Radian ABOVE the stated sticker weight here in Ontario Canada. It is otherwise installed as per the instructions for children over 48lbs in that it has been moved from LATCH to seatbelt, and is top tethered. THanks!!

i think the point is, if you have a severe accident and your child is injured or killed, through a means that you believe may have been caused by a defective or poorly designed carseat, you would not be able to sue the company. they are released of any liability.

if you think about it, it's a rare situation that's in question. sure, we've heard of the dorel lawsuits, and i'm sure every carseat maker out there has there own handful of lawsuits against them, but the numbers must be extremely low based on the sheer number of carseats out there.

I agree with SPB. And, I don't really think that all those Dorell lawsuits will make it through the courts either. I think that some are quick to jump on the band wagon trying to win some easy cash. JMO of course. :p

Technically you have released them of any liability by using the seat above the stated weight limit.

We do know that it is the identical seat as the 65lbs version, so whether that would play into the scenario in a court room or not, I don't know.

If you don't use it according to the manual, then you void the warranty and release them of any responsibility. By using it past the weight limit, you are not using it according to the directions in the manual.
